1. Data controller

2. Data and sources

We collect your name, your chosen contact method, the corresponding email address or phone number and any other contact details you provide voluntarily. We also collect the area or municipality, property type, bedrooms, the property’s current situation and your intended start date.

We record a reference, the date of receipt and an acknowledgement that you have read the policy, with its date and version. This acknowledgement is not consent to advertising.

To check that the internal notification has been sent, we also record the attempt’s status, its date and, when supplied by the provider, the message identifier. These records do not indicate whether the email has been opened or any link has been clicked.

If the link contains campaign tags, we save only utm_source, utm_medium, utm_campaign, utm_content and utm_term, restricted to acquisition tags. We do not save gclid, fbclid or the entry URL in the request record. Do not include personal or sensitive data in campaign tags.

The data comes from you and from the tags in the access link. The form does not ask for identity documents or health data. Hosting providers may process technical connection data to deliver and protect the service; this information is not added as fields to the form record.

3. Purposes and legal bases

Assessment and contact: we review your request and a possible management proposal, and reply using your chosen method. The legal basis is taking pre-contractual steps at your request, under Article 6(1)(b) of the GDPR. Requesting an assessment does not commit you to a contract or sign you up for advertising.

Handling your request includes sending an internal notification to the Maison Privat inbox so that we can respond. Resend sends this on behalf of the controller. No additional consent is requested for this operational notification.

We do not use Resend for advertising, newsletters or tracking opens or clicks. The notification is sent to Maison Privat and does not add the data subject to any mailing list.

Internal measurement: we use UTM tags to understand which channels generate requests and guide our acquisition efforts. The legal basis is Maison Privat’s legitimate interest in assessing the effectiveness of its channels, under Article 6(1)(f) of the GDPR. We have documented an assessment balancing necessity and impact and limited measurement to this purpose. We do not create profiles, personalise advertising or send this data to Google or Meta for advertising measurement. The application does not install pixels or use cookies or local storage for this attribution.

UTM parameters are kept exclusively in the D1 database for internal measurement. They are not included in notifications sent to Resend or in notifications received in Google Workspace.

You may object to this measurement by writing to info@maisonprivat.com. Maison Privat will stop using and delete the tags linked to your request from D1 through the internal dashboard, without preventing your assessment. You may request information about the balancing assessment carried out.

4. Required fields

You must provide the property details and the contact information needed to reply to you. If you choose email, a phone number is optional. If you choose phone or WhatsApp, an email address is optional. If you do not provide the chosen contact details, the form cannot be submitted. UTM tags are not needed to request an assessment.

5. Retention

If you do not enter into a contract, we retain the request for six months from receipt. Routine conversations and follow-ups do not change that deadline. Only genuinely active, documented negotiations close to the deadline allow retention to be extended by up to three months from each review, with a specific date and justification.

If you expressly agree to resume the conversation after the ordinary deadline, we will retain the necessary data until the agreed date. No automatic period is added after that contact. Requests for erasure or objections are handled without waiting for the deadline.

UTM tags are deleted when the request is erased, or earlier if you object. If you enter into a contract, only the data needed for contract management will be transferred, subject to the corresponding retention criteria and information.

The retention criteria also apply to operational copies of the request received by email. Deleting the D1 record does not automatically delete the notification from the inbox or copies retained by the sending provider. Where appropriate, erasure will extend to those copies and the provider’s assistance will be requested. Objections to UTM measurement are handled by deleting those tags from D1, without deleting the request or its email notification, which contains no UTM data.

Maison Privat uses Resend’s Free plan. According to the provider’s documentation, email data and logs are retained for 30 days and backups for 7 days. If earlier erasure is needed, Maison Privat will request it from the provider. These technical periods do not extend the request retention period set out in this policy.

Where data must be retained to meet legal obligations or liabilities, it will be blocked or access-restricted and kept solely for that purpose for the applicable period.

6. Providers and recipients

The controller and persons authorised to handle requests have access.

OpenAI Ireland Ltd. acts as a processor to host, maintain and support the site through ChatGPT Sites, under its data processing addendum. Cloudflare, Ltd. is part of OpenAI’s sub-processor chain for infrastructure and hosting; the request database uses Cloudflare D1. In this project, D1 is infrastructure managed by Sites, not a separate service contracted by Maison Privat with Cloudflare.

Resend, provided by Plus Five Five, Inc., acts as a processor to send internal form notifications under its data processing agreement. Maison Privat contracts this provider for these notifications separately from OpenAI’s hosting service and its Cloudflare D1 infrastructure.

Once the request is recorded, the site’s server sends Resend the name and contact details provided, preferred contact method, area, property type, bedrooms, current situation, intended start date, reference and date of receipt, and Maison Privat’s sender and recipient addresses. It does not send UTM parameters.

If you provide an email address, it is also used as the notification’s Reply-To address so that Maison Privat can reply directly to you. Resend also processes the technical metadata needed to manage sending and delivery. It has no direct access to the D1 database.

Google Workspace is used to receive and retain the notification at info@maisonprivat.com and for email communications when Maison Privat replies by email. The notification is sent as Maison Privat <avisos@notificaciones.maisonprivat.com>. Resend handles sending; Google Workspace manages the receiving inbox and subsequent communications from it. If you choose WhatsApp and we communicate that way, the conversation takes place through WhatsApp, under that service’s applicable terms. The form does not automatically send its content to WhatsApp.

Data may be disclosed to authorities where there is a legal obligation.

7. International transfers

The ChatGPT Sites addendum provides that, when OpenAI Ireland Ltd. transfers data from the European Economic Area to affiliates or third parties outside that area, it does so on the basis of standard contractual clauses or a European Commission adequacy decision. Resend carries out its main processing operations and stores service data in the United States, including message content and delivery logs. Selecting a European region for sending emails does not mean that storage takes place in the European Union.

Its processing agreement incorporates the European Commission’s standard contractual clauses; module two applies to the relationship between Maison Privat as controller and Resend as processor. Resend also states that it participates in the EU–US Data Privacy Framework as an additional mechanism, without the standard contractual clauses depending on that certification. Google Workspace may process data outside the European Economic Area under its terms of service and Cloud Data Processing Addendum, which provides for transfer mechanisms, including standard contractual clauses where applicable: https://cloud.google.com/terms/data-processing-addendum. You may request information about the relevant safeguards at info@maisonprivat.com.

8. Rights

You may request access, rectification, erasure, restriction, portability or object where applicable by writing to info@maisonprivat.com. You can provide your reference to help locate your request. We will ask for additional identity information only when necessary because of reasonable doubts.

In particular, you may object to processing based on legitimate interests on grounds relating to your situation. For UTM measurement, Maison Privat will honour the objection by deleting your request’s tags.

You may lodge a complaint with the Spanish Data Protection Agency, https://www.aepd.es/.

9. Decisions and external services

Requests are reviewed personally. No solely automated decisions with legal or similar effects are made.

Fonts are served from the site itself, without the browser connecting to Google Fonts to download them.

“Book a stay” opens the external Smily/Happystay booking engine. It does not automatically transmit data from the owner enquiry form. Bookings are subject to their corresponding privacy information.
